This privacy policy governs your use of the software application Daynamica (the “Application”) for mobile devices that was created by the Daynamica, Inc. (“Daynamica”, “we”, us or “our”) The Application collects and processes location and motion sensing data in real time to automatically construct a timeline of activity and travel episodes in the present day (such data, the “User Activity Data”); and enables users to provide information on each constructed episode in real time, including information on emotional experiences. 

Unless otherwise specified, Daynamica collects the User Activity Data and other data as specified below from you on behalf of a third party (for example, a research team or consulting company) and only after such third party (the “Data Collector”) has entered into an agreement with you with regard to collecting your User Activity Data (and other data and information) using the Application (such agreement, the “Data Collection Agreement”).

What information does the Application obtain and how is it used?

User Provided Information 

The Application obtains the information you provide when you download and register the Application. Registration with us is optional. However, please keep in mind that you may not be able to use some of the features offered by the Application unless you register with us.

When you register with us and use the Application, you generally provide (a) username, password, and other information that is required by the Data Collector pursuant to the Data Collection Agreement you entered into with the Data Collector ; (b) your interactions with a third party via the Application, such as when you respond to any study recruitment efforts from the Data Collector that provide compensation in exchange for data provision; (c) information you provide to us when you contact us for technical support; and; (d) information you enter into the Application, such as the answers you provide to a survey embedded in the Application. 

We may also use the information you provided us to contact you from time to time to provide you with important information such as changes to the privacy policy and new application features.

Automatically Collected Information 

In addition, the Application collects the location and motion information of the phone automatically. The information is used to derive information about your daily activity and trip episodes including start and end times, activity locations, trip origins and destinations, trip trajectories, travel speed, and travel mode.

Does the Application collect precise real time location information of the device?

The Application uses GPS and other location sensing technologies embedded in a smartphone to determine the real-time location of the phone. Based on such location information the Application then determines whether you are in an activity or trip status and  records your activity location and trip trajectory. 

Location data will only be shared with the third parties that you have consented to provide such data to, and the nature of this sharing will be governed by the terms of your agreement with those third parties. 

If at any time you do not wish the Application to collect location data, you may turn off data collection services for the Application located in the Settings menu within the mobile application. Note that disabling the collection of location data may affect your eligibility for compensation under the Data Collection Agreement  you have entered into.

Do third parties see and/or have access to information obtained by the Application?

Except in the special circumstances described below, we will only share the User- Provided and Automatically- Collected Information with the Data Collector(s) you have entered into a Data Collection Agreement with. If a Data Collector has a stricter data privacy policy (e.g., requiring deletion of the data after study completion) than the rules set forth in this policy, we will adhere to the rules set forth in the Data Collector’s data privacy policy. 

We may disclose User Provided and Automatically Collected Information in the follow two special circumstances:

  • as required by law, such as to comply with a subpoena, or similar legal process;
  • when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others; 

We may aggregate user-provided and automatically collected information to create de-identified datasets which do not contain individually identifying information, and provide no reasonable basis for identifying an individual. These de-identified datasets may be used to create marketing materials and/or commercializable data insights.  

If Daynamica, Inc. is involved in a merger, acquisition, or sale of all or a portion of its assets, you will be notified via email and/or a prominent notice on our Web site of any change in ownership or uses of this information, as well as any choices you may have regarding this information.

What are my opt-out rights?

You can stop all collection of information by turning off the data collection services for the Application located in the Settings menu within the Application.  In addition, you can stop all collection of information by the Application easily by uninstalling the Application. 

Data Retention Policy, Managing Your Information

Unless otherwise specified in your Data Collection Agreement with a third party, we will retain User Provided and Automatically Collected data for as long as you maintain an account with us. Once an account is deactivated, we will delete all User Provided and Automatically Collected data associated with the account within 90 days, though we may retain aggregate, de-identified data as provided above.

Children

We do not use the Application to knowingly solicit data from or market to children under the age of 18. If a parent or guardian becomes aware that his or her child has provided us with information without their consent, he or she should contact us at info@daynamica.com. We will delete such information from our files within a reasonable time.

Security

We are concerned about safeguarding the confidentiality of your information. We provide physical, electronic, and procedural safeguards to protect information we process and maintain. For example, we limit access to this information to authorized employees and contractors who need to know that information in order to operate, develop or improve our Application. Please be aware that, although we endeavor to provide reasonable security for information we process and maintain, no security system can prevent all potential security breaches.

Changes

This Privacy Policy may be updated from time to time for any reason. We will notify you of any changes to our Privacy Policy by posting the new Privacy Policy here and informing you either directly via email or indirectly via the third party you entered into a data collection agreement with.  You are advised to consult this Privacy Policy regularly for any changes, as continued use is deemed approval of all changes. 

Your Consent

By using the Application, you are consenting to our processing of your information as set forth in this Privacy Policy now and as amended by us. “Processing,” means collecting, storing, deleting, using, combining and disclosing information, all of which activities will take place in the United States. Unless otherwise specified by your data collection agreement with the third party, if you reside outside the United States your information will be transferred, processed and stored there under United States privacy standards.
